These Terms of Service (“Terms”) govern your access to and use of www.pocketpayments.com, including submitting inquiries, requesting payment reviews and accessing information about payment solutions.

The website provides general information and a way to contact Pocket Payments. It does not itself process payment transactions or replace any separate agreement between a merchant and a payment processor, acquiring bank or service provider.

By using this website, you agree to these Terms. If you submit information on behalf of a business, you confirm that you are authorized to do so.

1. Eligibility and Authority

You must be legally capable of agreeing to these Terms. If you use the website on behalf of a business or other organization, you confirm that you have authority to act on its behalf and bind it to information or requests you submit.

2. Acceptable Use

You may use the website only for lawful business purposes.

You must not:

  • Submit false, misleading or unauthorized information.
  • Attempt to gain unauthorized access to the website or related systems.
  • Interfere with the website’s security, availability or operation.
  • Introduce malicious code or use the website for fraudulent or harmful purposes.
  • Copy, scrape or systematically collect website content without permission.
  • Infringe the rights of Pocket Payments or any third party.

Do not submit full payment-card numbers, banking credentials, passwords or other sensitive financial information through general website forms.

Submitting a form does not create a merchant-processing agreement or require Pocket Payments or any third party to provide services.

Any pricing, savings estimate, equipment recommendation or other information provided during a preliminary review is informational and non-binding unless included in a separate written agreement.

4. Payment Services and Third-Party Agreements

Pocket Payments may introduce businesses to or assist them with services offered by payment processors, acquiring banks, technology providers and other third parties.

Payment-processing services are subject to:

  • Application and underwriting approval.
  • Verification of business and financial information.
  • Applicable pricing, fees and service terms.
  • Equipment availability and compatibility.
  • Separate agreements with the applicable provider.

Approval, pricing, funding times, equipment availability and savings are not guaranteed.

If these Terms conflict with a separate written merchant or service agreement, the separate agreement governs the services covered by that agreement.

5. Third-Party Fees and Transactions

The Pocket Payments website does not itself authorize, settle or fund payment-card transactions.

Transaction fees, monthly charges, equipment costs, chargebacks, reserves, funding terms and other financial obligations are governed by the applicable processor, acquiring bank or service-provider agreement.

Pocket Payments is not responsible for actions or decisions made independently by card networks, issuing banks, acquiring banks, processors or other financial institutions, except to the extent otherwise required by law or expressly stated in a separate written agreement.

6. Accuracy of Website Information

We attempt to keep website information accurate and current, but payment products, pricing, features, compatibility and availability may change.

Website content is provided for general informational purposes and should not be treated as a final quote, approval or contractual commitment.

You are responsible for reviewing all applicable agreements, pricing schedules and service terms before accepting a payment solution.

7. Intellectual Property

Unless otherwise stated, website content—including text, graphics, design elements and original materials—is owned by or licensed to Pocket Payments and protected by applicable intellectual-property laws.

You may view and use the website for legitimate internal business purposes. You may not reproduce, modify, distribute, sell or commercially exploit website content without prior written permission.

11. Disclaimers

Pocket Payments disclaims warranties that are not expressly stated in these Terms or a separate written agreement, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, Pocket Payments will not be liable for indirect, incidental, special, punitive or consequential losses arising from use of or inability to use the website.

This includes lost profits, lost business opportunities, lost data or business interruption.

Nothing in these Terms limits liability that cannot legally be limited, including liability arising from fraud, wilful misconduct or another obligation that applicable law does not permit a party to exclude.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold Pocket Payments harmless from third-party claims, damages and reasonable expenses resulting from:

  • Your unlawful or unauthorized use of the website.
  • Information or materials you submit without authorization.
  • Your infringement of another person’s rights.
  • Your material violation of these Terms.

This obligation does not apply to the extent a claim was caused by Pocket Payments’ own unlawful conduct or negligence.

14. Governing Law

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Subject to any rights that cannot legally be waived, disputes relating to these Terms or the website will be submitted to the courts located in Toronto, Ontario.

The revised Terms will be posted on this page with an updated “Last Updated” date. Changes will take effect when posted unless another effective date is stated.

16. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

A failure to enforce a provision does not waive the right to enforce it later.
